  1. INTRODUCTION AND WHO WE ARE

Always Ready Water, LLC ("Always Ready Water," "we," "us," or "our") is a company organized and operating in the State of Utah, United States. We sell in-home potable water storage tank systems for emergency preparedness, related accessories, preparedness education resources, and product support services through our website at www.alwaysreadywater.com (the "Website").

This Privacy Policy ("Policy") describes how we collect, use, disclose, retain, and protect personal information about individuals who visit our Website, make purchases, communicate with us, or otherwise interact with our business (collectively, "you" or "Consumer"). This Policy applies to personal information collected through the Website, by telephone, by email, and through any other channel through which you interact with Always Ready Water.

This Policy is incorporated by reference into our Terms of Service and, together with those Terms, governs your relationship with Always Ready Water. Capitalized terms used but not defined in this Policy have the meanings given to them in our Terms of Service.

  1. DEFINITIONS

As used in this Policy:

  • "Personal Information" means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with a particular individual or household.
  • "Sensitive Personal Information" means personal information that reveals a consumer's Social Security number, financial account credentials, precise geolocation, contents of private communications, health data, or other categories designated as sensitive under applicable law.
  • "Consumer" means any individual who is a resident of the United States acting in an individual or household context who uses the Website or purchases Products or Services from Always Ready Water.
  • "Controller" means Always Ready Water, which determines the purposes and means of processing your personal information.
  • "Processor / Service Provider" means a third party that processes personal information on our behalf and pursuant to our written instructions, subject to contractual obligations of confidentiality and data protection.
  • "Sale" means the exchange of personal information for monetary consideration to a third party. Always Ready Water does not sell personal information for monetary consideration.
  • "Targeted Advertising" means displaying advertisements to a consumer based on personal information obtained from the consumer's activities across non-affiliated websites or online services.
  • "Data Breach" means unauthorized acquisition of, access to, use of, or disclosure of personal information that compromises its security, confidentiality, or integrity.
  1. PERSONAL INFORMATION WE COLLECT

We collect personal information in the following categories, depending on how you interact with us:

  • Identification and Contact Information. Full name, mailing address, billing address, delivery address, email address, and telephone number. Collected when you create an account, place an order, submit an inquiry, or contact us.
  • Transaction and Purchase Information. Order history, product selections, order amounts, payment method type (we do not store full card numbers), shipping details, and related transaction records. Collected when you place an order or complete a purchase.
  • Payment Information. Payment card type, billing address, and the last four digits of your payment card. Full payment card numbers, CVV codes, and bank account details are processed directly by our third-party payment processor and are never stored on our systems.
  • Account Credentials. Username and hashed password if you create an account on the Website.
  • Communications and Correspondence. Records of emails, telephone calls, and other communications you initiate with us, including customer service inquiries, warranty requests, and product support communications.
  • Technical and Usage Information. IP address, browser type and version, device type, operating system, referring URL, pages visited, time and duration of visits, and other log and analytics data automatically collected when you access the Website.
  • Cookies and Tracking Data. Data collected through cookies, web beacons, pixel tags, and similar technologies as further described in Section 11 of this Policy.
  • Preferences and Preparedness Information. Information you voluntarily provide about your home or property configuration, water system type, or emergency preparedness needs for purposes of product consultation.
  1. HOW WE COLLECT PERSONAL INFORMATION

We collect personal information through the following channels:

  • Directly from you, when you create an account, place an order, fill out a form, subscribe to email communications, contact us by phone or email, or otherwise provide information to us voluntarily.
  • Automatically, through the Website, using cookies, server logs, and similar tracking technologies that collect technical and usage information when you browse or interact with our Website. See Section 11 for more detail.
  • From third-party service providers, including payment processors, shipping and freight carriers, email service providers, analytics platforms, and customer relationship management tools, that process data on our behalf and share limited information with us as necessary to provide services.
  • From publicly available sources, including address verification services and fraud detection databases, where permitted by law.

We do not knowingly collect personal information from children under the age of thirteen (13). The Website is not directed at children. If we become aware that we have inadvertently collected personal information from a child under thirteen, we will delete that information promptly. If you believe a child has provided us with personal information, please contact us using the information in Section 20.

  1. PURPOSES FOR WHICH WE USE PERSONAL INFORMATION

We use personal information only for the purposes identified below, and only to the extent reasonably necessary for those purposes:

  • Order Fulfillment and Transaction Processing. To receive, process, confirm, fulfill, ship, and follow up on orders for Products and Services, and to manage payment authorization and fraud prevention.
  • Account Management. To create and maintain your account, verify your identity, and provide you with access to your order history and account preferences.
  • Customer Service and Product Support. To respond to inquiries, assist with product questions, process returns and warranty claims, and provide product support.
  • Communications About Your Order. To send order confirmations, shipping notifications, delivery updates, and other transactional communications directly related to your purchase.
  • Marketing and Promotional Communications. To send you product updates, preparedness tips, promotions, and other marketing communications, subject to your right to opt out at any time as described in Section 12.
  • Website Operation and Improvement. To administer, maintain, troubleshoot, and improve the Website, to analyze usage patterns, and to develop new features and content.
  • Safety and Compliance. To comply with applicable laws, regulations, legal process, and governmental requests; to enforce our Terms of Service and other agreements; to detect, investigate, and prevent fraud, security incidents, and other harmful or illegal activity; and to protect the rights, property, and safety of Always Ready Water, our Customers, and the public.
  • Business Operations. To maintain our business records, conduct internal audits, manage insurance, and carry out other legitimate business operations.

We will not use your personal information for purposes materially different from those described above without providing you with prior notice and, where required by applicable law, obtaining your consent.

  1. LEGAL BASES AND PRINCIPLES FOR PROCESSING

Always Ready Water processes personal information in accordance with applicable law and the following principles:

  • Contractual Necessity. We process identification, contact, transaction, and payment information as necessary to enter into and perform our contract with you — specifically, to fulfill your order and provide Services.
  • Legitimate Interests. We process technical and usage information for Website operation, security, fraud prevention, and business improvement, where these interests are not overridden by your privacy rights.
  • Compliance with Legal Obligations. We process and retain certain records as required by applicable federal and state law, including tax law, consumer protection law, and data retention requirements.
  • Where required by applicable law (including for certain marketing communications and cookies), we process personal information only upon your consent. You may withdraw consent at any time as described in Section 12.

Always Ready Water applies the principle of data minimization: we collect and retain only the personal information that is reasonably necessary for the identified purposes and do not collect personal information speculatively or for undefined future use.

  1. DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES

Always Ready Water does not sell your personal information for monetary consideration to any third party, and does not share your personal information for targeted advertising purposes. We disclose personal information only in the following circumstances:

Service Providers and Processors. We share personal information with third-party service providers that process data strictly on our behalf and pursuant to our instructions, subject to written data processing agreements that require them to maintain the confidentiality and security of your information. Categories of service providers include:

  • Payment processors (for payment card authorization and fraud detection)
  • Shipping and freight carriers (for delivery of Products to your address)
  • Email service providers (for transactional and marketing communications)
  • Website hosting and cloud infrastructure providers
  • Analytics and website performance platforms
  • Customer relationship management and order management platforms
  • Legal, accounting, and professional services providers

Manufacturers and Warranty Administrators. Where you purchase a Product subject to a manufacturer warranty (including Flexcon Industries), we may share your name, contact information, and purchase details with the manufacturer as necessary to register your warranty or facilitate a warranty claim.

Legal and Regulatory Disclosures. We may disclose personal information to law enforcement agencies, courts, regulatory authorities, or other third parties where required or permitted by applicable law, including in response to a valid subpoena, court order, or government request, or to protect the rights, property, or safety of Always Ready Water, our Customers, or the public.

Business Transfers. In the event of a merger, acquisition, sale of all or substantially all of our assets, bankruptcy, or other business transition, personal information may be transferred to the acquiring or successor entity as part of that transaction, subject to appropriate confidentiality and data protection obligations.

With Your Consent. We may disclose personal information to other parties with your prior express consent.

We require all third parties that receive personal information from us to maintain appropriate security measures and to use that information only for the authorized purposes.

  1. DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to maintain our business records, and to comply with applicable legal obligations. In determining retention periods, we consider the following factors:

  • The nature and sensitivity of the personal information and the potential risk of harm from unauthorized use or disclosure.
  • The purposes for which we collected the information and whether we can achieve those purposes through other means.
  • Applicable legal, regulatory, tax, accounting, and reporting requirements.
  • The need to preserve records for dispute resolution, warranty administration, and enforcement of our agreements.

As a general guideline, we retain transaction and order records for a minimum of seven (7) years following the date of purchase to comply with tax, warranty, and consumer protection requirements. Account information is retained for as long as your account remains active and for a reasonable period thereafter. Technical and usage data collected through analytics is typically retained for a period not to exceed twenty-four (24) months.

When personal information is no longer required for a legitimate business or legal purpose, we will securely delete or de-identify it in accordance with our data retention procedures. We do not retain personal information in identifiable form longer than is necessary.

  1. DATA SECURITY

Always Ready Water implements and maintains reasonable and appropriate administrative, technical, and physical security measures designed to protect the confidentiality, integrity, and availability of personal information against unauthorized access, use, disclosure, alteration, or destruction. Our security practices include, without limitation:

  • Encryption of personal information in transit using industry-standard Transport Layer Security (TLS) protocols.
  • Access controls and role-based permissions limiting access to personal information to authorized personnel who have a legitimate need to access it for business purposes.
  • Third-party payment processing through PCI-DSS compliant payment processors, such that full payment card data is never transmitted to or stored on our systems.
  • Regular review of our data collection, storage, and processing practices to identify and address security risks.
  • Contractual data security obligations imposed on all service providers that access or process personal information on our behalf.

While we take the security of your personal information seriously and apply commercially reasonable safeguards, no method of data transmission or storage is completely secure. We cannot guarantee the absolute security of your information. You bear responsibility for maintaining the security of your own account credentials and for promptly notifying us of any suspected unauthorized access to your account.

In the event of a Data Breach that is reasonably likely to cause harm to affected individuals, we will notify affected Consumers and the appropriate authorities as required by applicable state and federal law, including the Utah Notice of Security Breach statute (Utah Code § 13-44-202) and applicable California and multi-state breach notification requirements where applicable.

  1. UTAH CONSUMER PRIVACY ACT (UCPA) — YOUR RIGHTS AS A UTAH RESIDENT

If you are a resident of the State of Utah acting in an individual or household context, the Utah Consumer Privacy Act (Utah Code § 13-61-101 et seq., "UCPA"), effective December 31, 2023, grants you certain rights with respect to your personal information. Always Ready Water is committed to honoring these rights.

Your rights under the UCPA include:

  • Right to Know / Confirm. You have the right to confirm whether Always Ready Water is processing your personal information.
  • Right to Access. You have the right to access the personal information that Always Ready Water has collected about you.
  • Right to Delete. You have the right to request that Always Ready Water delete personal information that you have provided to us, subject to applicable exceptions.
  • Right to Data Portability. You have the right to obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
  • Right to Opt Out of Sale. You have the right to opt out of the sale of your personal information to third parties. As noted in this Policy, Always Ready Water does not sell personal information for monetary consideration.
  • Right to Opt Out of Targeted Advertising. You have the right to opt out of the processing of your personal information for purposes of targeted advertising. Please see Section 12 of this Policy for how to exercise this right.

To exercise any of the above rights, please submit a request using the contact information provided in Section 20. We will respond to verified requests within forty-five (45) calendar days of receipt, as required by the UCPA. In limited circumstances, we may extend this period by an additional forty-five (45) days with prior notice. We will not discriminate against you for exercising any right under the UCPA.

Please note that the UCPA does not create a private right of action. Enforcement of the UCPA is by the Utah Attorney General and the Utah Division of Consumer Protection. Fines for non-compliance may reach $7,500 per violation.

  1. CALIFORNIA PRIVACY RIGHTS (CCPA / CPRA)

If you are a resident of the State of California, the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA"), grants you specific rights regarding your personal information. These rights are in addition to any rights you may have under the UCPA or other applicable law.

Please note that Always Ready Water is a growing company primarily serving Utah and surrounding markets. Depending on our annual revenue and the volume of California consumer data we process in any given year, formal CCPA obligations may or may not currently apply to us as a covered business. Regardless of our formal legal obligations under the CCPA, we extend the following rights as a matter of policy to California residents:

  • Right to Know. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, our business or commercial purpose for collecting it, and the categories of third parties with whom we share it.
  • Right to Delete. You may request that we delete personal information we have collected about you, subject to applicable exceptions.
  • Right to Correct. You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt Out of Sale or Sharing. We do not sell or share personal information for cross-context behavioral advertising. No opt-out action is required, but you may contact us to confirm this at any time.
  • Right to Limit Sensitive Personal Information. You may request that we limit the use and disclosure of any sensitive personal information we collect to purposes authorized by law.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

California residents may submit rights requests using the contact information in Section 20. We will respond within forty-five (45) calendar days of receipt of a verifiable request. You may designate an authorized agent to make a request on your behalf; we will require appropriate verification. In California, unresolved CCPA complaints may be directed to the California Privacy Protection Agency (CPPA) at cppa.ca.gov.

"Shine the Light" Notice (California Civil Code § 1798.83): California residents who have an established business relationship with us may request information about any personal information we have shared with third parties for those parties' direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes without your consent.

  1. YOUR CHOICES, OPT-OUT RIGHTS, AND COMMUNICATIONS PREFERENCES

Regardless of your state of residence, we provide you with the following choices regarding your personal information:

Marketing Communications. We may send you promotional emails, product updates, and preparedness tips. You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any marketing email, or by contacting us directly at the contact information in Section 20. Opting out of marketing communications will not affect transactional communications related to an active order or account.

Cookies and Tracking. You may configure your browser settings to refuse all cookies or to alert you when cookies are being sent. Please note that disabling certain cookies may impair the functionality of the Website, including your ability to complete a purchase or access your account. Most browsers provide instructions for managing cookies in their help documentation.

Analytics Opt-Out. Where we use third-party analytics platforms (such as Google Analytics), you may opt out of analytics tracking by using the tools provided by those platforms, such as the Google Analytics Opt-Out Browser Add-on available at tools.google.com/dlpage/gaoptout.

Account Deletion. If you have created an account on the Website, you may request deletion of your account by contacting us as described in Section 20. Account deletion requests are subject to our data retention obligations and will be honored to the extent permitted by applicable law.

Do Not Track. Some browsers transmit "Do Not Track" (DNT) signals to websites. At this time, there is no universally accepted standard for how websites should respond to DNT signals. Our Website does not currently alter its data collection or use practices in response to DNT signals.

If you use a third-party payment processing interface presented within the Website checkout experience, your payment information is transmitted directly to and processed by the payment processor. Always Ready Water does not receive, transmit, or store your full payment card data.

  1. CHILDREN'S PRIVACY AND COPPA COMPLIANCE

Always Ready Water's Website and Services are directed exclusively to adults. We do not knowingly collect, solicit, or process personal information from children under the age of thirteen (13), in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506, and its implementing regulations.

If we become aware that we have collected personal information from a child under thirteen without verifiable parental consent, we will delete that information as promptly as practicable. If you are a parent or legal guardian and believe that your child has provided personal information to Always Ready Water, please contact us immediately using the information in Section 20 and we will take steps to remove that information from our systems.

The UCPA similarly defines a "child" as an individual under thirteen years of age and requires verifiable parental consent for the processing of children's personal data. We comply with this requirement and apply the COPPA verifiable parental consent standard in satisfaction thereof.

  1. INTERSTATE DATA TRANSFERS AND MULTI-STATE PRIVACY RIGHTS

Always Ready Water is headquartered in Utah and primarily serves Customers in Utah and surrounding regional markets. Because our Website is accessible throughout the United States, we may collect personal information from residents of states other than Utah. Where applicable state privacy laws are triggered — including, but not limited to, those of California (CCPA/CPRA), Colorado (CPA), Virginia (VCDPA), Connecticut (CTDPA), Texas (TDPSA), Oregon (OCPA), and other states with comprehensive privacy laws — we will honor the consumer rights established by those laws to the extent they apply to our data processing activities.

As of the effective date of this Policy, an expanding number of U.S. states have enacted comprehensive privacy legislation. We monitor this evolving landscape and update our practices as necessary to comply with applicable law. If you are a resident of a state not specifically addressed in this Policy, please contact us using the information in Section 20 and we will address your request in good faith in accordance with applicable law.

All personal information collected by Always Ready Water is stored and processed on servers located within the United States. We do not transfer personal information to recipients outside the United States.

  1. VERIFYING AND RESPONDING TO CONSUMER RIGHTS REQUESTS

To protect your privacy and the security of your personal information, we require that all consumer rights requests be verified before we fulfill them. Our verification process is designed to confirm that the requestor is the individual to whom the personal information relates (or an authorized agent acting on their behalf), without creating an undue burden.

When you submit a request, we will ask you to provide sufficient information to verify your identity, which may include your full name, email address on file, mailing address, and order number (if applicable). We will not use information provided for verification purposes for any other purpose.

If you submit a request through an authorized agent, we will require written authorization from you (the Consumer) designating the agent, as well as verification of the agent's own identity. We reserve the right to deny requests where we cannot reasonably verify identity, or where applicable law permits or requires us to decline.

We will respond to verified consumer rights requests within the timeframes required by applicable law: forty-five (45) calendar days under the UCPA (extendable by an additional forty-five (45) days with notice); and forty-five (45) calendar days under the CCPA (extendable by a further forty-five (45) days with notice). Responses will be delivered via the email address associated with your account or request. We will not charge a fee for responding to requests unless they are manifestly unfounded, excessive, or repetitive.

  1. BUSINESS TRANSFERS AND ORGANIZATIONAL CHANGES

If Always Ready Water undergoes or considers a merger, acquisition, corporate reorganization, sale of all or substantially all of its business assets, bankruptcy, or other material business transition, personal information held by Always Ready Water may be among the assets reviewed in connection with such a transaction and, if the transaction is completed, transferred to the acquirer, successor, or new controlling entity.

In such circumstances, we will take reasonable steps to ensure that any recipient of personal information is bound by data protection obligations substantially similar to those described in this Policy. Where required by applicable law, we will provide notice to affected Consumers and, where required, offer an opportunity to opt out of the transfer of personal information.

Any successor entity will be bound by this Policy as it existed at the time of the transfer unless and until the successor provides updated notice and obtains any required consents.

Always Ready Water reserves the right to update or amend this Privacy Policy at any time to reflect changes in our data practices, applicable law, or business operations.
